Shocking ‘Annulment’ lawsuit against Alanya Zoning Plan

Süleyman Hilmi Erdoğan, who retired after serving as a Building Control Technician at Alanya Municipality, claimed that some provisions regarding roof structures in the Alanya Zoning Plan are against regulations. Erdoğan announced that he would take legal action for annulment of these provisions and prosecution of council members who voted 'Yes'.

Erdoğan submitted his claims to the Antalya Administrative Court, stating that he is preparing to request the suspension and annulment of the relevant provisions of the zoning plan. The provisions under the heading “Roofs and Exterior Appearance” have resurfaced due to alleged conflicts with the Zoning Regulation for Planned Areas (PAİY) and the Spatial Planning Implementation Regulation (MPYY).

Erdoğan noted that the 2020-2021 “30% Common Area” amendment is still within the legal period for filing a lawsuit and that he will request annulment and suspension of the relevant provisions. He also stated that he will file a criminal complaint regarding the votes of the CHP and İYİ Party groups in the council meeting.

Alanya Municipality responded to Erdoğan’s petition by stating that the relevant plan provisions were added through the decisions of Alanya Municipal Council and Antalya Metropolitan Municipal Council, and that the provisions are publicly available on the municipality’s official website.
